Emergency Regulations

Finding Of Emergency
The Division of Elections finds that an emergency exists and that the attached election precinct regulations are necessary for the immediate preservation of the public peace, health, safety, or general welfare. The facts constituting the emergency are as follows:

On August 8, 2002, the Division of Elections adopted, as emergency regulations, changes in Title 6 of the Alaska Administrative Code dealing with precinct boundary descriptions.

The emergency regulations took effect August 8, 2002 and will expire December 5, 2002. The Division of Elections intends to make the emergency regulations permanent.

You may comment on the regulation changes, including potential costs to private persons of complying with the changes, by submitting written comments to the Division of Elections at PO Box 110017, Juneau AK 99801-0017. The comments must be received no later than 5:00 p.m. on September 6, 2002.

The Alaska Supreme Court ruled on March 21, 2002 that parts of the redistricting proclamation adopted by the Alaska Redistricting Board on June 18, 2001, were unconstitutional. The Alaska Redistricting Board issued a revised redistricting proclamation on April 25, 2002. This revised plan was provided to the state superior court and approved by that court on May 13, 2002. This plan was submitted to the United States Department of Justice for preclearance review on April 30, 2002. Preclearance of the April 25, 2002 plan was not received until June 10, 2002. The division has rewritten the legal descriptions for the election precincts in accordance with the April 25, 2002, plan. However, the United States Department of Justice also needs to review and approve any changes to election precinct boundaries before the changes go into effect. Between the current date and the date of the primary election, the division must hire election workers, notify the public of the location of polling place, and mail new voter registration cards to all voters. The division cannot adopt regulations amending the precincts using the regular procedures of the Administrative Procedure Act, because there would not be enough time to do all of those things, adequately inform the voters, and conduct the election in an orderly and timely fashion.

Adoption Order
Under the authority of AS 15.15.010 and AS 15.10.020, the attached 514 pages of regulations are therefore adopted as emergency regulations to take effect immediately upon filing by the lieutenant governor, as provided by AS 44.62.180(3).

This action is not expected to require an increased appropriation.
